Tipper Owner Drags Nigerian Army Captain to Court

A tipper Owner, Oluwatosin Adebanjo, has through his business manager, Ismail Muhammed, instituted a case of criminal intimidation contrary to Section 397 of the panel code, against one army officer, Captain Ezemegbu of the 23 Armoured Brigade, praying the court to compel the officer to pay the requisite amount for the recovery the complianants Tipper lorry seized by the Camerounian authority six months ago.

According to the legal documents made available to Daily Sun by the vehicle owner, Oluwatosin Adebanjo, which includes a complaint letter, put forward by one Reliance Law Chambers and addressed to the Brigade Commander, 23 Armoured Yola, and a case lodged at the Magistrate Court of Adamawa state, dated,  3rd and 13th of August, 2018 respectively, the military officer in question, is said to have hired the lorry tipper, through his business agent, one Isa Muhammed, for the transportation of some Madrid Woods.

The lettter further said, "The said Captain Ezemegbu used our clients Tipper Lorry to smuggle some contraband goods to Cameroon, on which our clients Tipper lorry was intercepted along Camerounian border by the Cameroon authority."

Explaining his predicament to Daily Sun, Oluwatosin said, "My vehicle has already spent six months in the hands of Camerounian authority and I don't have any means of livelihood.

"I have already spent more than N1.4 million trying to secure the release of my vehicle and my staff.

"My vehicle was captured with seven workers, one is my staff and the remaining six persons work for the officer, my contacts there informed me that one of the workers had already died in the Cameroon jail.

"Six months now since this vehicle was seized, my four children, Precious who is 13 years old, my twin boys, Taye and Kainde, 8 years old and their younger sister, Testimony who is just four year old, have not been able to attend school because this is my only source of income.

"I collected loan to buy the tipper, and it is making my life unbearable.

"The court I approached for help, required that I pay N50,000 naira for their services which did and later said that the captain has agreed to pay seven hundred and fifty thousand (N750,000) and that I should match up with another one hundred thousand (N100,000) to secure the release of my vehicle.

"I agreed and paid the amount to a designated account made available to me by the lawyer, I have not seen my money, and he has not been taken to Court.

"All I wanted is my tipper, they lied to me when the rented my tipper because they said that they were transporting some woods to a town called 'Ladan Sheta' within Toungo."
