Adamawa 2019: Fresh Trouble for Governor Bindow As Judge Recuses self from Certificate Scandal Case

Fresh trouble for Adamawa state governor Jibrilla Bindow as the judge presiding over his certificate forgery scandal, Justice Abdulaziz Anka, has recused himself from presiding over the case citing personal reasons.
Beginning hearing on the case on Wednesday,I Justice Abdulaziz Anka of the Yola Division of the federal High Court said he would return the case file to the chief Judge of the court for reassignment to another judge.
A non governmental organisation, Incorporated Trustees of Global Integrity Crusade Network had earlier in 2018 filed the case in the Abuja Division of the Federal High Court in October, challenging the qualification of the governor after alleging that the WAEC certificate he presented to INEC was false.
The case was heard in Abuja by Justice B.O. Quadri who ordered for accelerated hearing before it was later transferred to Yola Division of the court.
During the sitting in Yola, counsels to both parties had expressed readiness to proceed before Justice Anka requested for audience with them in his chambers and Soon after resumption, the judge recused himself from presiding over the case.
Responding to questions from the press, the Defence Counsel, Chris Uche (SAN) said the plaintiff had no locus standi in challenging the nomination of Governor Jibrilla in the case because they were neither, candidates nor indigenes of Adamawa State.
He said the case had been previously dismissed by a judge in Abuja for lack of basis, expressing confidence that his client would emerge victorious.
Reacting to the position of the defendant, the Counsel to the plaintiff, Edward Omaga said the plaintiff has evidence that the governor did not possess WAEC results and that WAEC authorities had filed papers at the court on Tuesday, confirming that the results Bindow presented was false.
"We do have evidence that he presented a false WAEC result. We have attached 10 exhibits and WAEC have filed yesterday that the certificate he presented belonged to a different person who attended the same school.
"Section 182 is clear, once you have submitted a false certificate to INEC, you cannot contest election," he maintained.
He disputed the defendant's claims, saying the plaintiff need not be citizens of Adamawa or contestants in the election to challenge Governor Jibrilla's qualification.
He explained that the case was initially struck out because the writ was not marked as concurrent to be used anywhere outside Abuja and the case was re-assigned the next day as soon as the writ was rectified
This court case a just opening day after the official flag off of governor Jibrilla's campaign for 2019 re-election and after the governor had been presented as the flag bearer of APC in Adamawa state by the national chairnan of APC, Adams Oshiomole.
This is the beginning of failure of APC in Adamawa state. They'll soon meet their Waterloo.
