APC Vs PDP: Adamawa Assembly Apprehensively Declares Lawmaker's Seat vacant Over Defection to APC. - APC Heads to Court, Demands Bororo Sack for Defecting to PDP

- APC Institutes Legal Action to Declare Seat of Member Who Defected to PDP Vacant

The Adamawa State House of assembly has been engulfed in a bitter conflict after the house declared the seat of the member representing Michika state constituency, Joseph Ayuba vacant for defecting from the ruling Peoples Democratic Party (PDP) in the state to the opposition All Progressives Congress (APC).

During Wednesday’s plenary presided over by the speaker of the house Rt. Hon Aminu Iya Abbas, the house citing section 109 1(G) of the constitution declared the seat of the lawmaker vacant by virtue of leaving his party under which flag he was elected.
 
Presenting the issue before the plenary attended by 13 of the 25 members, the deputy speaker, Pwamwakeno Mackondo citing section 109 of the constitution urged the House to declare the seat of the lawmaker vacant.
Iya Abbas then requested Mackondo to present the section of the constitution after which he put a motion for the declaration of the member’s seat vacant.

After the motion was moved and seconded, the speaker declared the seat of the lawmaker vacant and asked the clerk to inform relevant authorities including INEC of the House's decision.

Shortly following the action of the house, the All Progressives Congress (APC) in a counter action says it has mandated the legal department of the party to institute a legal action to declare the seat of the member representing Mubi north, Musa Bororo, vacant, after he announced his defection from the APC to the PDP on the floor of the house.

The APC in a press statement signed by its public relations officer, Muhammed Abdullahi,  condemned the actions of the house of Assembly challenging the manner in which the house was hastily assembled while on recess, the procedure followed in evicting the member and the selective implementation of justice in the house. 

The state reads in part, "The house should equally declare the seat of the member representing Mubi north vacant after he defected from the APC to PDP. 

"The Speaker of the Adamawa State House of Assembly is under oath to do justice to all manner of people and not to allow his personal interest to interfere with his official conduct but his action has proved otherwise.
"It is on record that Musa Umar Bororo announced his defection to PDP from APC on the floor of the house, the speaker warmly welcomed him and saw no offence in his action.

"Joseph Ayuba Kwada for strategic reasons did not announce his defection on the floor of house but the speaker based on personal interest and that of the Adamawa State governor hurriedly declared his seat vacant in a commando style.

"As a Party we therefore strongly condemn such clueless and selective justice in its entirety."

The statement adds that, we have resolved to challenge the following actions of the speaker in a court of competent jurisdiction saying that it would challenge, "The procedure followed in reconvening the house which has been on recess.

"How the house allows personal interest to interfere with official conduct.

"And the glaring injustice and partisanship in declaring Hon. Joseph Ayuba Kwada's seat vacant.

"By this statement the legal Adviser of our great party has been mandated to commence the legal action and equally ask the court to declare Hon. Musa Umar Bororo's seat vacant while we continue to pursue other political solutions as a Party."
